Today, most new legal software is delivered from the cloud. Both models still exist, and each has genuine merits — so here is what Scottish firms need to weigh up.

What the two models actually mean

With on-premise software, the system and your data live on servers your firm owns and maintains, usually in the office. With cloud software, the system is hosted in a secure, professionally run data centre and accessed over the internet through a browser or app — nothing critical is tied to a single machine in your building.

Security: the surprising part

Many solicitors instinctively feel that data kept on-site must be safer. In practice, the opposite is often true. Reputable cloud providers invest heavily in encryption, access controls, monitoring, ISO-certified data centres and round-the-clock security — protections that few small or medium firms could ever replicate in-house. On-premise systems, by contrast, often fall behind on security updates, reliable backups and remote-access controls unless a firm has real IT resource behind them.

The shift to flexible working made accessibility essential rather than optional. Cloud platforms let a firm keep operating from anywhere with an internet connection, and their automatic backups mean recovery from ransomware or hardware failure is far more straightforward than restoring a single on-site server. For firms with more than one office, or anyone who works outside it, this is often the deciding factor.

What to ask any provider

Whichever direction you lean, press vendors on the essentials: How is data encrypted, in transit and at rest? Where are the data centres located, and does that meet your data-residency requirements? How often are security audits carried out? What happens to your data if you cancel — is it returned or deleted? And how, exactly, would migration from your current system work?
